Wednesday, September 18
David Hoover, Tech & Telecom Policy Advisor
National Association of Towns & Townships (NATaT)
On August 2, the Federal Communications Commission (FCC) adopted new rules updating the Communications Act’s cable franchising regulations. The Third Report and Order requires “in-kind payments other than the capital costs of public, educational, and governmental (PEG) access channels to be counted toward the statutory five percent cap on franchise fees. It also prohibits local franchise authorities “from regulating the provision of most non-cable service, including broadband Internet access service.
The webinar will provide an overview of the Commission’s order and practical advice for local franchise authorities including:
• Procedural history of the FCC rulemaking
• The effects on: in-kind contributions; mixed-use and non-cable services; and state franchising laws
• Litigation timeline and next steps
• Strategies to prepare for franchise negotiations
